​1. WHAT INFORMATION DO WE COLLECT?

 

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

 

We do not process sensitive information.

 

We may collect data necessary to process your payment if you make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is stored by Wix Payments, Adyen B.V., and Stripe. You can view their Terms and Conditions here:

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

 

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

 

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic usage, and performance information our servers automatically collect when you access or use our Site and which we record in log files. Depending on how long you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity on the site (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’), and hardware settings).

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Site. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

  • Location Data. We collect location data such as your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Site. 

 

We collect such Non-personal and Personal Information for the following purposes:

  • To provide and operate the Services;

  • To provide our Users with ongoing customer assistance and technical support;

  • To be able to contact our Visitors and Users with general or personalised service-related notices and promotional messages;

  • To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  • To comply with any applicable laws and regulations.

 

2. HOW YOUR INFORMATION IS STORED, USED, SHARED AND DISCLOSED

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may share your data with third-party vendors, service providers, contractors, or agents (‘third parties’) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. Thai means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organisation apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct. The third parties we may share information with are as follows:

  • Invoice and Billing

    • PayPal, Apple Pay, Stripe, WIx Payments, Adyen B.V.

  • Web and Mobile Analytics

    • Google Analytics

We may also need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not knowingly collect data from or market to children under 16 years of age. By using the Site, you represent that you are at least 16 years of age or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Site. If we learn that personal information from users less than 16 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 3. HOW WE COMMUNICATE WITH YOU

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section ‘HOW TO CONTACT US ABOUT THIS NOTICE’ below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section ‘HOW TO CONTACT US ABOUT THIS NOTICE’ below. You will then be removed from the marketing lists. However, we may still communicate with you - for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

6. CALIFORNIA RESIDENT PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc).

CCPA Privacy Notice:

The California Code of Regulations defines a ‘resident’ as: (i) every individual who is in the State of California for other than a temporary or transitory purpose and (ii) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. All other individuals are defined as ‘non-residents’.

If this term ‘resident’ applies to you, we must adhere to certain rights and obligations regarding your personal information. We have collected the following categories of personal information in the past twelve (12) months:

  1. Identifiers - Contact details, such as real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol Address, email address, and account name.

  2. Personal information categories listed in the California Customer Records statute - name contact information, education (NO), employment and employment history (NO), and financial information (NO).

  3. Protected classification characteristics under California or federal law - gender and date of birth.

  4. Commercial Information - transaction information, purchase history, financial details, and payment information.

  5. Biometric Information - fingerprints (NO) and voice prints (NO).

  6. Internet or other similar network activity - Browsing history (NO), search history (NO, online behaviour (NO), interest data (NO), and interactions with our and other websites, applications, systems, and advertisements.

  7. Geolocation - device location

  8. Audio, electronic, visual, thermal, olfactory, or similar information - images and audio, video or call recordings created in connection with our business activities (NO).

  9. Professional or employment related information - Business contract details in order to provide our Services to you at a business level or job title (NO), work history (NO), and professional qualifications if you apply for a job with us (NO).

  10. Education information - student records and directory information (NO).

  11. Inferences drawn from other personal information - inferences drawn from any of the collected personal information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics (NO).

  12. Sensitive personal information - (NO).

We will use and retain the collected personal information as needed to provide the Services or for:

  • Category’s B and G as long as the user has an account with us.

 

We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

  • Receiving help through our customer support channels;

  • Participation in the customer surveys or contests; and

  • Facilitation in the delivery of our Services and to respond to your inquiries.

 

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be ‘selling’ of your personal information.

Alicia W. Photos has not sold or shared any information to third parties for a business for a commercial purpose in the preceding twelve (12) months. Alicia W. Photos has disclosed personal information of Categories B and G for a business or commercial purpose in the preceding twelve (12) months.

The categories of third parties to whom we disclosed personal information for a business or commercial purpose can be found under ‘HOW YOUR INFORMATION IS STORED, USED, SHARED AND DISCLOSED’.

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain expectations provided by law such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to project against illegal activities.

Depending on the circumstances, you have a right to know: whether we collect and use your personal information; the categories of personal information that we collect; the purposes for which the collected personal data is used; whether we sell or share personal information to third parties, the categories of personal information that we sold, shared, or disclosed for a business purpose; the categories of third parties to whom the personal information was sold, shared, or disclosed for a business purpose; he business or commercial purpose for collecting, selling, or sharing personal information; and the specific pieces of personal information we collected about you.

In accordance with the applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights:

We will not discriminate against you if you exercise your privacy rights.

Right to Limit Use and Disclosure of Sensitive Personal Information.

We do not process consumer's sensitive personal information.

Verification Process:

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other Privacy Rights:

  • You may object to the processing of your personal information.

  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.

  • You can designate an agent to make a request under the CCPA on your behalf. We may deny a request from an agent that does not submit proof that they have been validly authorised to act on your behalf in accordance with the CCPA.

  • You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

7. PRIVACY POLICY UPDATES

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
